IP Renewal Process and IP Renewal Services in Pakistan

Intellectual Property (IP) is defined as the original work of an individual or a group of individuals, that work could be anything such as designs of something, idea, material, product, brand, written content etc. and that individual or group of individuals holds the exclusive rights of that work and they themselves can only use it and no one else is allowed to use without their permission or consent. If intellectual property is used by someone that doesn't hold the rights then he or she will be punished by the law governing bodies. These rights can be achieved by registering your product or design from regulating bodies of your country. The registration of intellectual property can be done for a limited period of time and it expires after a certain period, that depends on the rules of each country.

Intellectual property is of different forms. It can be a copyright or trademark or a patent. Each type of intellectual property is registered for a different time period. In Pakistan, Intellectual Property Organization (IPO) is responsible for the registration of all forms of IP. So, if you have invested in the registration of IP then you should know that this registration is limited and you need to renew it if you want to keep your work protected from being copied.

Trademark Renewal:

In Pakistan, the trademark act was amended in April 2004 but the trademarks that were filed or registered before that, they are treated according to the Trademark act of 1940. So according to the latest act, the trademark registration is valid for 10 years and if it expires, you can renew it for another 10 years. The renewal must be done when there are 6 months left in the expiration of the registration. In between those 6 months, you can pay the IP renewal fee and renew your IP. But if you are not able to renew your IP within the given time, you are still able to renew it within 4 months after the expiration. The late renewal includes the additional charges as a late fee.

Patent Renewal:

If you have filed a patent for your novel invention, then you must renew it before it expires so that your invention remains yours. A patent is expired after 4 years of registration and it is renewed every year after 4th year of its registration until 20th year. For the renewal, you have to submit application of renewal before the expiry date. The renewal fee is increased every year. If you get failed to renew your patent, then you have still chance to restore it, you can submit the application of restoration before permanent invalidation of your patent. After 20 years the invention is open for public for research purpose, but it cannot be claimed by anyone.
