Trademark & Copyright Registration:

A trademark is a unique symbol used to represent a business or its products. It is a thing that distinguishes your products from other traders and organization, hence providing your brand the best security. After registration the same symbol or series of words cannot be used by any other organization.As long as it remains in use of first one. Trademarks are actually the marks that represent your business. Once the protection is done for the trademark it means it is certified that only you can use that mark for your products. So, in order to protect the trademark, trademark registration is needed. If the person is facing some issues about the trademark, trademark attorney are there for guiding you.

Copyright

Copyright is a basically a law that permits the owner to say how other people can use it. It protects the author from being re-copied of their works without permission. In order to register a copyright, you just need to submit an application to the U.S Copyright Office. The registration can also be done through the mail or online.

Trademark Registration in Pakistan:

For the registration of trademark application should fill “TM Form 55” with the required trademark. If there is no similar trademark, the application moves to the next stage otherwise the applicant is asked to give another trademark for search by filling a new form.

If there is no similar result on the proposed trademark, the applicant has to fill an Application Form called TM form 1 or TM form 2 for registration with the following documents:

  • The Application Form TM Form 1 or TM Form 2.
  • Eight copies of the proposed trademark that may be a word, symbol, logo, features, or whatever.
  • A complete list of goods orproducts, which are represented by the trademark.
  • A proof of payment in the name of the respective administrator that is Director General, IPO, Pakistan.

After submitting these an acknowledgement report is sent to the applicant.

When there are no objections made on the application, the trademark is then allowed to publish by IPO

When there is no objection within two months of publishing the request of trademark registration is accepted. The applicant is asked to pay the trademark registration fee and fill the TM Form 11 to obtain the trademark registration certificate.

Once the applicant clears the payment, Trademark Registration Certificate is issued. But the trademark required renewal every ten years for which applicant has to fill TM Form 12 along with the renewal fee.

Copyright or Trademark Infringement:

Infringement of intellectual property means using ones a copyright or trademark, without the permission of the owner. These include unauthorized reproduction, distribution, public performance, or displaying of material. Copyright and trademark infringement is illegal and the violator of this law must be punished. The penalties for copyright and trademark infringement are:

  1. Infringer should pays the dollar amount of damages
  2. The law provides a range from $200 to $150,000 for each work infringed.
  3. Infringer pays for all attorneys’ fees and court costs.
  4. The Court can issue an injunction to stop the infringing acts.
  5. The Court can impound the illegal works.
  6. The infringer imprisonment.

Protection of Brand:

Brand is an image, quality, reputation and the name which actually makes you realize that how much you to mean to your customers and trademark is the strong protection for your brand which prevents your competitor by stealing your reputation.

Copyright allows owner right to their creations. Other people cannot the protected property in any way without permission from the copyright holder. Copyright protection must be registered with the government to provide protection. Copyright is done through the Copyright Office and has less registration fee. Unlike trademark, it is a rather quick process.
